Smith became the seventh Minnesotan to win three elections for attorney general and the first (and only) to run unopposed in a general election. However, Smith also became the first state attorney general to die in office, on March 4, 1918. Governor J.A.A. Burnquist appointed Deputy Attorney General Clifford Hilton to fill the seat.
