Associate Justice Collins was reelected to a fourth term without opposition. Collins was the second candidate to not face an opponent following Associate Justice John Berry in 1884. Collins resigned on March 31, 1904 to campaign for the Republican gubernatorial nomination. Governor Samuel Van Sant appointed Wallace Douglas to fill the vacancy effective April 5, 1904. Douglas was an attorney from Moorhead, former two-term state Representative (HD 50, 1895-1899), and Attorney General (1899-1904).
