Richardson contested the election of fellow Republican Henry Hoepner on the statutory grounds from the Apportionment of 1866 that only one member of the two-seat delegation was to be from Stearns County with the other from the balance of the district. Richardson was a resident of Little Falls in Morrison County. Hoepner and the incumbent Rep. Overbeck were residents of St. Cloud while Miner was a resident of Sauk Centre. The House awarded the seat to Richardson on January 18, 1867.
